Renoma Hotel (“the Hotel”) welcomes your choice to browse the website operated at: https://renomahotel.com/ (“the Site”).

The Site was established to provide customers and users of the Site with a convenient and safe platform for booking and purchasing accommodation and vacation packages at the Hotel (“the Services”). Additionally, the Site provides information about the Hotel, accommodation options, and other services offered by the Hotel. Our Privacy Policy governs how we collect, process, and transfer personal information (as defined in the Privacy Policy) (hereinafter: “the Privacy Policy”). It should be noted that we publish an additional Privacy Policy concerning the use of the Simple Booking platform through which reservations are made.

Use of the Site:

These Terms and Conditions constitute a binding agreement between you, whether personally or on behalf of an entity (“You”), and the Hotel concerning your access to and use of the Site on any computer or other communication device such as a mobile phone, tablet computers, and the like. They also apply to the use of the Site, whether through the Internet or through any other network or communication means, including access to the Site via phone, application, or other means. Please read the Terms and Conditions carefully, as browsing the Site and performing actions on it signifies your agreement to the terms contained in these Terms and Conditions (“the Terms”). If you do not agree to all of the provisions of the Terms, you are prohibited from accessing or using the Site or the Services.

In the event of any conflict between these Terms and any translation into another language, the Hebrew version shall prevail in all legal matters or questions of interpretation or otherwise.

The Hotel reserves the right to change the Terms from time to time, at its sole discretion and without prior notice. We will update you regarding changes to the Terms by updating the “Last Updated” date in the Terms, and you waive any right to receive specific notice of such changes. Your continued use of the Site or the Services after the effective date of the revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease using the Site.

Purchasing and using the Site are intended only for individuals with legal capacity who are 18 years of age or older.

The provisions of these Terms apply equally to both genders, and the use of the feminine and/or masculine form is for convenience only.

Intellectual Property:

Unless expressly stated otherwise, all copyrights and intellectual property rights in the Site, including, designs, images, databases, software, code, audio, video, text (“the Content”), as well as logos, trademarks, and the like (“the Marks”) are solely owned by the Hotel, or by a third party who has authorized the Hotel or granted the Hotel a license to use the Content or Marks according to law, including the Hotel’s business partners.

The Content and the Marks are provided “AS IS” for your personal use only. Unless expressly stated otherwise, you shall not copy, distribute, publicly display, publicly perform, transmit to the public, modify, adapt, create derivative works of, sell or rent any part of the foregoing, whether directly or indirectly or through or in cooperation with a third party, by any means or method, whether electronic, mechanical, optical, photocopying or recording means, or by any other means and manner, without the prior written consent of the Hotel or the other rights holders, as applicable, and subject to the terms of the consent (if granted).

Provided that you are eligible to browse the Site, the Hotel grants you a limited license to use it and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.

User Representations:

By browsing the Site and/or registering for the Hotel’s newsletter and/or loyalty club, you undertake and declare as follows: (1) browsing the Site and using the Services are at your sole risk; (2) the details you entered when providing your information and purchasing on the Site are true, current, accurate, and complete; (3) if necessary, in case of a change in details, you will update them by contacting the Hotel; (4) you have the legal capacity and you agree to the Terms; (5) you will not use the Site by automated or non-human means, whether through a BOT, script, or otherwise, and you will not collect data by these means; (6) you will not make illegal use of the Site; (7) your use of the Site will not violate any relevant law or regulation.

The Hotel may prevent any user from using the Site at its absolute discretion. Without derogating from the above, the Hotel may block access to the Site or part of it if, while submitting details on the Site, intentionally incorrect, outdated, or incomplete details were provided.

Prohibited Activities on the Site:

You may not access or use the Site for any purpose other than that for which the Site is intended. The use of the Site is permitted for private and personal purposes only and may not be used for commercial purposes except those specifically and in writing approved by the Hotel. In case of commercial use of the Site, the Hotel will be entitled to take legal action against the user.

The Hotel may prevent users from placing an order on the Site and/or cancel a user’s order on the Site in the event of improper conduct and/or commercial use of the Site and/or unreasonable use of the Site and/or non-compliance with the Terms and Site policies and/or any other reason, at its sole discretion.

As a user of the Site, you agree not to:

Retrieve data or other content from the Site to create or compile a collection, database, or directory without prior written permission from the Hotel;

Make any use of the Site’s designs;

Make unauthorized use of the Site, including collecting email addresses, other content, and the like by electronic or other means for the purpose of sending emails by automated means;

Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict use or copying of any Content;

Defraud or mislead the Hotel and/or its users;

Make improper use of the Site’s support services or submit false reports of abuse or misconduct;

Make automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools;

Attempt to impersonate another person;

Use any information obtained from the Site in order to harass, abuse, or harm another person;

Use the Site as part of any effort to compete with the Hotel;

Retrieve, decompile, or reverse engineer any part of the Site, a feature on the Site, or an application on the Site;

Harass, intimidate, or threaten any of the Hotel’s employees or agents;

Delete the copyright or other proprietary rights notice from any Content or Mark;

Copy or adapt the Site’s code or any part of it, including but not limited to Flash, PHP, HTML, JavaScript, or other code;

Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material, including excessive use of spamming, which interferes with the Site’s use;

Take any action that damages or harms the Site, as determined by the Hotel’s sole discretion;

Use the Site in a manner inconsistent with any applicable law, regulation, and judicial ruling.

Any use of the Site in violation of the above may result, among other things, in termination or suspension of your rights to use the Site.

Third-Party Content:

The Site may provide links to other websites (“Third-Party Sites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from Third-Party Sites (“Third-Party Content”). Third-Party Sites and Third-Party Content, with the exception of the Simple Booking reservation engine platform, are not investigated, monitored, or checked by the Hotel, and the Hotel is not responsible for any Third-Party Content posted through the Site, accessed through the Site, available through the Site, or installed on the Site, including the content, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Sites or the Third-Party Content. The inclusion of any link to a Third-Party Site or permitting the use or installation of any Third-Party Content does not imply approval or endorsement thereof by us.

The Hotel assumes no responsibility for any purchases you make from Third-Party Sites or other companies, which will be valid exclusively between you and the relevant third party, except for purchases made through the Simple Booking reservation engine platform, as stated in Section 5.1 (referring to the Hebrew text’s numbering).

Site Management:

We reserve the right to: (1) monitor the Site for violations of these Terms; (2) take legal action against anyone who violates the law or the provisions of these Terms, at the Hotel’s sole discretion, including, without limitation, reporting the user to law enforcement authorities; (3) refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your contributions to the Site or any portion thereof, at the Hotel’s sole discretion and without limitation; and (4) manage the Site in a manner designed to protect its rights and property and to facilitate the proper functioning of the Site.

User Content and Copyright Infringement:

The Services may allow you to add or submit certain content and/or data, such as reviews (hereinafter: “User Content”). The Hotel may collect User Content from other websites.

You are solely responsible for any User Content you submit and/or upload within the framework of the Site and/or the Services. You declare and warrant that the User Content complies with all legal provisions, that you hold all necessary rights to upload or submit the User Content to the Services, and that the User Content does not infringe (or lead to infringement of) any intellectual property right, moral right, right of publicity, or right to privacy of a third party. We do not guarantee to accept, display, review, or maintain any User Content. Furthermore, we reserve the right to remove and permanently delete any content, including User Content, without prior notice, for any reason and at any time. We do not endorse any content, opinion, or recommendation expressed in the Content and/or by any particular user, and we expressly disclaim any liability concerning the Content, including, without limitation, User Content.

We may choose, at our sole discretion, to monitor User Content to detect improper or unlawful behavior, including by automated means; however, the Company is not obligated to monitor User Content or the user’s manner of using the Services. The Company may do so, and may also remove User Content and/or restrict the use of the Services, if in its discretion such use or User Content violates any of the user’s obligations under these Terms.

The User Content you input, send, publish, and/or upload while using the Services remains your exclusive property, and all intellectual property rights in your User Content are yours. By inputting, sending, publishing, or uploading any User Content in connection with the Services, you grant the Company, its successors, and assignees a perpetual and ongoing, worldwide, non-exclusive, royalty-free, and transferable license to use, copy, distribute, transmit, modify, and create derivative works of such User Content for the purpose of providing the Service and improving the Company’s services, including commercial use. Without derogating from the above, you are aware that any User Content you choose to publish on the Site will be exposed to Site visitors and/or other users.

We respect the proprietary rights of others. If you believe that information or content, including User Content, on the Site infringes proprietary rights belonging to you, please contact us using the contact details at the bottom of these Terms.

Changes to the Site, Faults, and Service Interruptions:

The Hotel reserves the right to change from time to time or remove the content of the Site (including User Content) and/or to change or remove Services for any reason at its sole discretion and without prior notice. The Hotel is not obligated to update any information or content on the Site.

The Hotel will not be liable to you or any third party for any such modification, suspension, or discontinuation of service.

The Hotel does not guarantee that the Site and/or the Services will be uninterrupted, provided in an orderly manner or without interruptions, will occur securely and without errors, and will be immune from unauthorized access to the Hotel’s computers or from damages, malfunctions, faults, or failures – all in hardware, software, communication lines, and systems at the Hotel or at any of its suppliers.

Ordering and Purchasing on the Site:

Ordering and purchasing will be done through the Site’s reservation system. Accommodation units can be booked through the system, and requested dates as well as required reservation details can be entered.

Prices, availability of Services, and other purchase conditions may change from time to time. The Hotel reserves the right to change the range of Services or discontinue them or change the price of the Services offered on and off the Site, without prior notice.

Commercial ordering will not be permitted on the Site. For commercial ordering, contact the Hotel using the contact details displayed at the bottom of the Terms.

When ordering a Service on the Site, the purchaser is responsible for providing correct, accurate, current, and complete information. Entering false purchase details is strictly prohibited. The Hotel may verify the details entered after an order is placed, and may cancel or limit the order at any time if the details provided are found to be incorrect. If payment was made for a canceled order, the Hotel will refund the payment amount to the same payment method, subject to the Hotel’s cancellation policy.

If, for any reason, the credit card company refuses to transfer the payment amount for an order you placed, the Hotel will be entitled to immediately suspend or discontinue the provision of the Service and may demand payment plus any cost incurred by the Hotel due to the refusal (including penalties from a third party) by other means, at the Hotel’s discretion. If the Hotel is forced to take legal action to collect outstanding payments, the purchaser undertakes to indemnify the Hotel for all expenses incurred, including attorney’s fees and additional court expenses.

The purchase of Services on the Site is subject to additional terms and conditions which will be detailed on the Site.

It is clarified that as part of the purchase on the Site, several messages will be sent to the customer, such as order confirmation, an invoice for the purchase (if made), information about the order, and more. The Hotel reserves the right to transmit the messages by any means of communication, such as email or SMS to the phone.

An order will be considered confirmed only after receiving an order confirmation from the Hotel, which includes the confirmation number and order details.

The Hotel may unilaterally not approve an order placed and/or confirmed on the Site, or cancel an order placed on the Site and automatically confirmed, according to the Hotel’s decision and discretion, in cases where there was an error in the order, including an error in the transaction price, a technical error, an error in the publication of the Service, a policy error, and any other human error. The cancellation will be made up to 72 hours from the time of the order, but no less than 30 days before the date of the booked vacation.

If the Hotel cancels a transaction as described in Section 9.9, the Hotel will not charge the customer for the cost of the transaction and will contact the customer to complete the transaction correctly.

The entry of credit card details during the order process is for deposit purposes only, unless otherwise displayed and/or required on the Site during the order or by the Hotel.

Unless otherwise displayed or required as stated, payment for the order will be made at the Hotel upon arrival, or according to what is written in the order’s cancellation policy.

Without derogating from the above, it is clarified that after submitting the credit card details, the Hotel may perform a validity check of the credit card with the relevant credit card company. As part of this check, a framework of NIS 10 may be temporarily held, solely for the purpose of checking the credit card’s validity, without actual charge. The held framework will be automatically released according to the credit card company’s policy and no later than 30 days from the completion of the check.

Cash payment, subject to Hotel approval, will be made in accordance with the law, including according to the provisions of the Law for Reducing the Use of Cash, 5778-2018.

Order Modification and Cancellation Policy:

A request for a transaction modification or cancellation must be submitted to the Hotel using one of the contact methods listed at the bottom of the Terms or through the personal area.

Cancellation of accommodation services and a monetary refund will be possible within 14 days of making the transaction or from the date of receiving the transaction details (whichever is later), provided that more than 7 days, which are not rest days, remain until the accommodation date. In a distance selling transaction made by a person with a disability, a senior citizen, or a new immigrant, as defined in the Consumer Protection Law, when the transaction involved communication between you and the Hotel (including communication through electronic means), you are entitled to cancel the transaction within four (4) months from the day of the transaction or from the day of receiving the document containing the main points of the transaction, whichever is later, as long as the cancellation is made before the Service is provided.

In case of cancellation as stated in Section 10.2 above, the customer will be charged a cancellation fee of NIS 100 or 5% of the value of the order, whichever is lower.

Our cancellation policy is the Hotel’s basic policy. Specific and/or additional conditions may apply in connection with various promotions offered by the Hotel. These specific conditions will appear during the reservation process during the purchase and in the order confirmation, and they will apply in connection with such an order.

No refund will be allowed in case of an order from a price list that includes immediate, full or partial payment, for a cancellation made after 14 days from the date of the order or the date of receipt of the transaction details document (whichever is later) and the cancellation date does not fall within 7 days, which are not rest days, prior to the accommodation date, or in case of no-show at the accommodation complex without prior notice.

Cancellation and refund will be approved after the customer receives a notification from the Hotel confirming it.

Any refund will be made by the payment method used by the customer for the purchase.

The above is subject to the provisions of transaction cancellation in accordance with the Consumer Protection Law, 5781-1981.

Hotel’s Liability:

The contents of the Site are provided for use on an “AS IS” basis, and cannot be tailored to the needs of every individual. The user of the Site agrees that they will have no claim, suit, or demand against the Hotel regarding the nature of the contents, their capabilities, their limitations, and/or their suitability for their needs, and the use of the Site will be the sole responsibility of the user.

The user of the Site agrees that the use of the Site will be at their sole and full responsibility. The Hotel does not guarantee that the content and services published on the Site will be complete, correct, or accurate, or will meet the expectations and requirements of every user. The Hotel will not bear any responsibility for any result that will derive from them, or from the use of them, or from reliance on them, including: (1) errors, mistakes, and inaccuracies; (2) personal injury or property damage, of any kind, caused due to the use of the Site and/or purchase on the Site; (3) interruption in access to the Site or from the Site; (4) any bug, virus, Trojan horse, and the like that may be transmitted to the Site by any third party.

The information appearing on the Site should not be considered a promise of any outcome and/or a guarantee of the manner of activities of the Services sold on it. The Hotel will not be responsible for any damage, direct or indirect, that will be caused to the user as a result of relying on information appearing on the Site (including any Content and/or User Content) and/or links to other websites and/or any other internal and/or external source of information and/or use of the Services presented by it.

The images on the Site are displayed for illustrative purposes only. There may be differences in appearance, shade, size, and the like between what is displayed on the Site and the Service provided to the customer. A clerical error in the description of a Service and/or its price will not bind the Hotel.

Information and representations about products and/or services displayed on the Site, originating from the Hotel’s business partners and/or third parties whose products and/or services appear on the Site and any content in relation to the products and/or services, are the exclusive responsibility of the said business partners and/or third parties, and therefore it is understood that the Hotel has no responsibility for such information, and the Hotel does not guarantee the accuracy of this information.

The responsibility for entering the correct purchase details and also ordering the requested Service, dates, accommodation units, meals, and any other Service rests solely with the customer. The Hotel will not be responsible for errors made by the customer.

The Hotel recommends that Site users act as savvy and careful consumers, and carefully read the information displayed on the Site, including the information regarding the Service itself, its description, and its suitability, as described on the Site.

The provision of the Service will be possible subject to the Hotel’s sole discretion, and the Hotel will not be responsible for any delay and/or deferral in the provision of the Service and/or non-provision of the Service, as a result of force majeure and/or events beyond its control, including war, strike or lockout, sabotage, public disorder, act or omission of a third party or restrictions imposed by it, laws, regulations, orders, or other governmental instructions, security restrictions, pandemic, lockdown, or other circumstances beyond its control.

The Hotel will not be responsible in the event that an order and purchase were not received in the system and/or in case of technical failures on the Site and/or any other problem preventing the user from placing an order and purchase on the Site.

Jurisdiction:

These Terms and the use of the Site will be governed exclusively by the laws of the State of Israel, but the international choice of law rules stipulated therein will not apply.

The courts of the Tel Aviv District will have exclusive jurisdiction in any matter arising from and/or related to the Terms and/or legal disputes that arise between you and the Hotel.

Accuracy/Technical and Other Corrections:

The Site as a whole, including all the information appearing on it, is offered to the public “as is,” and will be as accurate and correct as possible, however, the information may not be complete, or alternatively, there may be technical or other errors in the information. The Hotel reserves the right to correct such errors and/or mistakes and/or inaccuracies and to update the information on the Site at any time and without prior notice.

Indemnification and Limitation of Liability

Subject to all law, the Hotel shall not be liable for any non-conformity, lack, misleading or error regarding the Content in the Services and/or on the Site, including regarding the nature or suitability or description of the Services offered on the Site. Subject to all law, the Hotel shall not be liable for any damage caused directly or indirectly due to the use of the Site and/or the Services. You undertake and declare that you are aware and agree that the use of the Services and the Site is at your sole risk. The use of the Site, the Services and/or the Content displayed in them is provided to you “AS IS” and subject to its availability (“AS AVAILABLE”), according to the Hotel’s decision and without any warranty of any kind, including their being personally suitable for your needs.

You will have no claim, suit, or demand against the Hotel regarding the Terms and/or the Site, the Services, their capabilities, their limitations, or their suitability for your needs. Subject to all law, any reliance on the Content (including User Content) is at your sole responsibility, and the Hotel disclaims all liability, express or implied, regarding the accuracy, reliability, timeliness, currentness, quality, completeness, usefulness, security, or performance of the Site and/or the Services and/or the Content and/or the User Content and/or that all information available through the Site and/or the Services and/or the Content (including User Content) will be error-free or that the errors, if any, will be corrected.

Subject to all law, the Hotel disclaims all warranties of any kind, express, implied, or statutory, and does not warrant that the Site and/or the Services will be provided in an orderly manner or without interruptions, will be of high quality, will occur securely or without errors and/or disruptions, or will be immune from unauthorized access to the Hotel’s computers and/or software, or from damages, malfunctions, faults, or failures, inter alia in hardware, software, communication lines, and systems at the Hotel or at any of its suppliers or at yours, and you will have no claim against the Hotel in connection therewith. You are aware that the Site and/or the Services may not be available in the future due to maintenance needs, upgrade, or for any other reason.

Third Parties. We cannot control the services provided by third parties and we are not responsible for any failure or interruption of a telephone line or network, or Internet traffic overload or on the Site itself. We cannot control the actions of malicious entities and we do not guarantee that we will be able to prevent unauthorized access or modification of the Site and/or the Services.

Users. We cannot anticipate or control the actions or omissions of others, including our users. We are not responsible, regardless of the form of action, for the actions or omissions of all users that do not stem from gross negligence or intentional conduct on our part.

Information Preservation. We are not a data storage service. It is your sole responsibility to back up any information you provide to us. If the information you provide to us is lost or damaged for any reason, we will not be responsible for any damage or loss caused to you if you are unable to restore the information.

Subject to all law, the Hotel, its managers, officers, employees, agents, or shareholders shall in no event be liable to you or any third party for any loss, damage, or compensation whatsoever, including, without limitation, indirect, incidental, consequential, supplementary, secondary, punitive, or special damage or compensation (including but not limited to damage for loss of database, loss of software, costs of procuring substitute service, violation of privacy, or service interruptions) arising out of or relating to these Terms, the use of or inability to use the Site, the Services, the Content (including User Content) and/or anything related to them, from a transaction performance, or as a result of unauthorized use of the Site or the Services, as a result of modification of the information provided by you, including damage caused as a result of loss of profits, use and loss of information, and other intangible assets, even if the Hotel has been advised of the possibility of such losses. To the maximum extent permitted by law, the Hotel’s total and cumulative liability under any term of these Terms shall not exceed the amount you paid to the Hotel in connection with the Services in the three (3) month period before the relevant claim.

Personal information may be obtained from you during your use of the Site and/or the Services. Any use made by the Hotel of the personal information obtained during your use of the Site and/or the Services will be subject to the provisions detailed in the Privacy Policy. You are aware that by providing the said personal information, including and without limitation, contact details, you declare that you are aware of the risks involved and you release the Hotel from any responsibility for this.

In light of the above, you understand that the use of the Site and the Services involves a certain degree of risk. When you choose to use the Site and the Services, you do so at your sole discretion while assuming the risks involved. According to applicable law, liability limitations in certain areas may not be possible, and some of the above limitations of liability may not apply to you. Check the relevant law for you regarding limitations concerning the exclusion of implied liability.

You undertake to bear full responsibility for any direct or indirect consequence that occurs due to your use of the Site or the Services. Accordingly, you agree to indemnify the Hotel, its employees, managers, and/or anyone acting on its behalf and to defend them against any claim, argument, demand, loss, loss of profit, payment, expense, or damage, including attorney’s fees and court expenses (including, of a third party), arising, directly or indirectly: (a) from your violation of one or more of the Terms or by a user of your device or personal account; (b) as a result of your manner of use or attempt to use the Site or the Services; (c) violation of any legal provision to which you are subject; (d) violation of any right (including intellectual property) of the Hotel and/or any third party; (e) violation of any of your representations and warranties under the Terms, and (f) any other matter for which you are responsible under any law.

Termination:

These Terms shall remain in full force and effect while you use the Site and/or the Services. Without derogating from any other provision of these Terms, the Hotel reserves the right to deny any user access to the Site (including blocking certain IP addresses), for any reason or cause (without needing to provide a reason or cause), at its sole discretion, without the need for prior notice or warning and without being liable for any damage as a result of its decision. Also, the Hotel may terminate your use of the Site and/or the Services and any Content (including User Content) or information you posted on the Site at any time, without prior warning. Provisions of these Terms which by their nature are intended to continue to be in force after termination of use of the Site and/or the Services, including but not limited to provisions regarding limitation of liability, indemnification, intellectual property, jurisdiction, and confidentiality, will continue to apply even after termination of use of the Site and/or the Services for any reason.

Miscellaneous:

These Terms constitute the entire agreement and understanding regarding the use of the Site. Failure to exercise or enforce any right or provision in these Terms will not be considered a waiver by the Hotel of the exercise of the right or the enforcement of the provision. The Hotel will be entitled to assign all or part of its rights and/or obligations under these Terms to others.

Unless expressly stated otherwise, any notice under these Terms will be delivered in writing and will be deemed to have been duly given when delivered by hand against delivery confirmation, sent by recognized courier with tracking, or sent by email to the addresses detailed below or provided between the parties (or any updated address that will be provided in a notice). Notices to you will be delivered using the email address or by posting a prominent notice in your user interface or by any other reasonable means.

No party shall be liable for non-performance of any of its obligations under the Terms in case of force majeure, state of war, war, general mobilization, pandemics, fire, floods and other natural disasters, and any similar event beyond the reasonable control of a party to the agreement. The party affected by the force majeure event will notify the other party in writing, and will reasonably minimize the effects of the force majeure on the performance of its obligations. It is clarified that a force majeure event will not exempt a party from performing its obligations to pay any amount under these Terms.

Nothing in these Terms creates any agency, employment, joint venture, or partnership between you and the Hotel or authorizes you to act on behalf of the Hotel. The Terms reflect the entire agreements between the parties regarding the Terms of the Site and the Services and the relationship between the parties and will supersede any previous agreement or undertaking, oral or written. The Hotel may assign, transfer, or set over its rights and obligations under the Terms, or any part thereof, to any third party at its sole discretion. You are not permitted to assign, transfer, or set over your rights and obligations under the Terms or any part thereof, and any attempted assignment will be null and void.
